May 01, 2007 -- The TCEQ ED has concluded that ASARCO will not meet the requirements for renewing its permit and does not recommend issuance.
Nonetheless, the TCEQ ED has laid out a schedule which would allow ASARCO to start-up again...if it makes certtain plant improvements relating to, among others) the baghouses, the acid plants.
This recommendation by the ED is only a step in the process. The report provides a seven-week period for public comment, followed by six weeks for the ED to prepare responses to these public comments. Then, the matter will go to the TCEQ Commission for a decision, and then ASARCO has 365 days to make the improvements or else the permit expires.
The ED also recommmended that the permit only be granted for five yewars instead of ten "to ensure ASARCO maintains effective pollution control equipment and practices within a shorter timeframe than a regular renewal."Related Links
